LA CULPABILIDAD POR LA VULNERABILIDAD COMO MEDIDA DE LA PENA: UNA REVISIÓN AL CONCEPTO DE CULPABILIDAD

El problema de la culpabilidad quizá sea el más discutido y es del que menos acuerdo existe en la teoría del delito. Es obvio que ello obedece a que la culpabilidad corona la teoría del delito, y toda falla en los cimientos o en la planificación de la estructura teórica del delito, se hace más evidente a medida que se asciende en los estratos de la misma, pudiendo distorsionarlos totalmente por defecto de sustentación en las etapas anteriores. El problema surge cuando la culpabilidad deja de ser concebida como reprochabilidad y se sustenta en la peligrosidad, camuflándose así la peligrosidad en un derecho penal de acto, donde la respuesta punitiva del Estado no se dirige hacia lo que el autor hace, sino hacia lo que el autor es, desconociéndose el principio de antijuridicidad material. Es en este punto donde surge una especie de disolución conceptual del derecho penal contemporáneo bastante grave, que tiene raíces bastante profundas y consecuencias bastante graves.
