Abstract

The text exposes the assumptions on which the political and legal theory of Jürgen Habermas is based, with the aim of highlighting the importance of the philosophical foundations and the historical diagnosis of modern societies for the political-normative analysis offered by the same author. In this sense, the ideas of the democratic rule of law and the public sphere, which have been disseminated as Habermas' main contributions in terms of practical philosophy, can be connected with the whole complex theoretical construction and, specifically, the differences that the author has with other perspectives with respect to those ideas can be evidenced.
