Theoretically, the structure of the processes enshrined in Law 1437 of 2011 is designed to be developed in short terms; however, in practice, these terms are to be breached by various factors, so their observance is subject to the capacity of the courts, generating delays and congestion. That is why the legislator proposes a solution to said delays the materialization of the constitutional principle of speed. In this article, from a dogmatic and hermeneutical approach of the principle of momentum in the Colombian legal system, a critical analysis of the implementation of said principle in the oral processes of contentious-administrative jurisdiction is intended.
