This article aims to determine the importance of the protection of intangible assets (distinctive signs and trademarks) in Mexico and Spain in today's globalized market. Through the deductive method and documentary and legal research, the need to know the legal actions for protection is highlighted, since the contrary has entailed costs and difficulties for both the business project as a whole and the individual owners. The importance of registering the intangible called "trademark" for the subsequent commercial exploitation of the work is estimated.
