Law and Literature: Poetic Justice and Literary Realism

Narrativity is a way of investigating social problems that seeks the meanings through which those involved describe their experience. Following this paradigm, the relationship between law and literature is discussed, preferring Martha Nussbaum's proposal, for its ethical-political power. Our intention is to demonstrate that the so-called instrumental relationship with political pretensions with which her proposal has been criticized, is based on the ignorance of the aesthetic nature of the type of literature (realism) that the philosopher studies. For this, an analysis of literary realism is carried out to understand the socio-political condition of this literary movement and thus the political nature of Nussbaum's bet.
