Human dignity as a protected legal right in workplace harassment proceedings and the extraordinary remedy of cassation in the Colombian legal system

The procedence of the extraordinary remedy of cassation is analyzed based on the conception of the social rule of law; to this end, the legislative and jurisprudential evolution of this remedy in labor and social security matters is highlighted. In the scenario of protection and effective protection of rights and constitutional guarantees, cassation must be framed in a formal, material and effective justice, and for this purpose its technique must be made more flexible, especially when fundamental rights to work, due process and social security, among others, are involved. Emphasis is placed on labor harassment as a problem that afflicts workers and on the possible applicability of cassation to deal with it for the sake of the constitutional protection of the rights of the worker, having human dignity as the main axis and starting from the analysis of the jurisprudence in this regard in our country. It is proposed that the requirement for the granting of the extraordinary appeal in cassation is not an economic interest to appeal, but the effective protection of social human rights. In a concrete manner, the proposal is for a legal alternative to guarantee access to the administration of justice in cases of labor harassment and, in this sense, the extraordinary appeal in cassation is proposed as a space that makes possible the real protection of the fundamental rights of workers who may have suffered labor harassment.
