Principles and Rules: Intersectionality as a Principle of Interpretation in Constitutional Court Rulings

This article will analyze intersectionality as a theory that rigorously studies the social and political gap that arises in different acts of discrimination, in which there are heterogeneous factors and a multiplicity of characteristics of those who are in a state of vulnerability. To this end, we will study how the confluence of these characteristics —race, ethnic origin, age, sex, gender, sexual orientation, educational level, migratory situation, religious beliefs, identity, physical or mental disability, socioeconomic position, etc.— becomes a determining factor in the circles of discrimination and how intersectionality is presented as a tool that dynamizes its understanding and its approach in certain sociopolitical parameters, making it possible to establish the impact of discrimination for the adequacy of measures that protect and guarantee the fundamental rights of individuals.
