Reflections on the unconstitutionality of self-sought abortion in Mexico: case analysis in the legislation of the state of Coahuila

The purpose of this paper is to critically reflect on the constitutional implications of the ruling issued by the Mexican Supreme Court of Justice of the Nation in the Action of Unconstitutionality 148/2017, initiated by the Attorney General's Office of the Republic, against some norms of the criminal legislation of the state of Coahuila, related to the issue of the absolute prohibition of self-procured abortion. The case in question is relevant because several fundamental rights are involved and because it is one of the first rulings of a Constitutional Court in Latin America on the assumption of voluntary abortion. In order to fulfill the planned objective, based on the exegetical, legal dogmatic and case study methods, first of all, an introductory study will be made on abortion, its typology and some relevant data on the dimension of the topic, to later outline the legal panorama on abortion in Mexico. Next, we will address the background and approaches of the unconstitutionality action in question, and then we will refer to the main reasons that the members of the Court upheld, related to the unconstitutionality of the norms that criminalize voluntary abortion. Finally, based on the foregoing, some reflections will be made on the constitutional and legal implications of such determination, with a view to clarifying some guidelines for decriminalizing self-procured abortion throughout the country.
