El manejo del lenguaje resulta determinante en la resolución de conflictos interpretativos en el campo jurídico. A propósito de esto, se acude al debate que durante varios años han protagonizados los doctores Diego Eduardo López Medina y Javier Tamayo Jaramillo. En sus posiciones antagónicas sobre diferentes puntos jurídicos, el lenguaje adquiere un sentido formalista, en el caso del ex magistrado Tamayo Jaramillo, y antiformalista en las tesis del profesor López Medina. No obstante los diversos matices hermenéuticos, alinterior de un Estado Social de Derecho, en última instancia, el uso del lenguaje debe estar al servicio de la sustancia y no de la forma, tal y como lo preceptúa el artículo 228 de la Constitución Política.
