La constitucionalización del derecho privado

El presente artículo pretende advertir sobre los riesgos de la constitucionalización del derecho privado, mediante la aplicación del Neoconstitucionalismo, teoría que plantea que el derecho, además de reglas, comprende una serie de principios y valores, los cuales amplían el horizonte de la validez del mismo. La Constitucionalizacion del Derecho Privado, requiere de una adecuación, ya que las bases del clásico Estadoliberal sobre el cual se erigió, hoy se encuentran superadas por el nuevo Estado Constitucional; pero, dicho proceso podría conducir a una infra constitucionalización, al pretender encontrar en la Constitución todas la soluciones, prescindiendo de las demás normas. El Derecho Privado ha aportado a la evolución del derecho
constitucional y, el mismo, debe ser pasible de transformaciones, que atiendan la Justicia y la convivencia pacífica; pero, ese cambio debe hacerse sobre la base científica del mismo, para no caer en el error de llegar a su trivialización.
