La Acción de Repetición, consideraciones sobre la Ley 678 de 2001

La Acción de Repetición está consagrada constitucionalmente en el inciso segundo del Artículo 90 de la Constitución Política de Colombia, y desarrollada por el legislador en la Ley 678 de 2001, como una obligación que tienen los representantes legales de las entidades públicas, cuando han sido condenadas al pago de una indemnización a un tercero, de repetir contra sus agentes cuando existan indicios de que la conducta que ocasionó el daño estuvo originada en el dolo o la culpa grave. Para su análisis se consideraron los antecedentes de la responsabilidad estatal como presupuesto de la acción de repetición; asimismo, se describe claramente el procedimiento contemplado en la Ley 678 de 2001 para la implementación de la acción, además de considerar diferentes posiciones doctrinarias en torno a esta institución, definida constitucionalmente como una acción de interés público.Author Biography
