Efectos jurídicos de las licencias Copyleft Creative Commons, en el ordenamiento jurídico nacional

El desequilibrio entre la ecuación: derechos de la sociedad para acceder a la cultura vs. el derecho de los autores y titulares de los derechos patrimoniales de autor, para percibir una contraprestación económica por aportar al engrandecimiento cultural y científico de la sociedad, ha generado un movimiento de artistas, científicos y jurístas que buscan armonizar esta desprooporción que en la actualidad beneficia irracionalmente a la industria del entretenimiento. En ese sentido se han desarrollado en el mundo esfuerzos jurídicos para posibilitar la liberación del conocimiento. Las licencias Copyleft Creative Commons son una materialización de los citados esfuerzos, constituyendo instrumentos jurídicos que recientemente se están empleando en nuestro país.
