El derecho a la salud, como derecho fundamental y servicio público, implica hoy una base fundamental en el Estado de Derecho, pues en su discurrir histórico, inicialmente, no se contaba con esta obligación estatal. Sin embargo, a hoy, es un reto, pues los conflictos entre una visión garantista y material del derecho a la salud, y un mundo neoliberal e individualista, solo se resolverán de acuerdo a los factores reales de poder en la sociedad. No obstante, la humanidad, después de miles de años de historia, ha ganado la batalla, erigiendo el derecho a la salud como elemento inalienable de la naturaleza humana pese a que el Estado y la sociedad no lo reconozca, estará allí presente para recordar que está siendo vulnerado.
