Las personas “jurídicas” ¿Es adecuado denominar “ficticias” a las personas jurídicas? ¿Un pseudo-problema de esencias o un problema de significados?

En el presente artículo se pretende realizar una reflexión crítica acerca de los conceptos de persona y personalidad jurídica en el ordenamiento jurídico colombiano, específicamente, de la denominación de “ficticias” dada a las personas jurídicas en el artículo 633 del Código Civil. El análisis se justifica dada la vaguedad, ambigüedad e indeterminación de los conceptos aludidos en los instrumentos normativos nacionales, tanto legales como del orden constitucional, y de los internacionales llamados a formar parte del denominado bloque de constitucionalidad.
