Acercamiento al bien jurídico salud pública

La delimitación y comprensión del bien jurídico salud pública, como interés protegido en algunas normas de conducta estipuladas en la parte especial del Código Penal colombiano, debe iniciar por su consagración positiva en la esfera internacional y luego en la nacional, como campo de lo jurídicamente establecido. Lo anterior no significa desconocer que el bien jurídico tiene su fuente en la realidad social, la cual es positivizada en un momento dado por parte de quienes ostentan el poder para ello, siempre y cuando lo hagan sujeto a las reglas previamente establecidas. Adicional a ello, se debe acudir a la doctrina penal. La razón obedece a que las reflexiones dogmáticas han permitido vincular de manera consciente la realidad con la ley, para dar respuesta pertinente al conflicto social y, a la vez, suministrar claridad en cada norma penal a las características básicas de la conducta punible.
