El juez como figura trágica. La paradoja de lo legal y lo justo en la administración de justicia en Colombia desde la perspectiva de la fenomenología narrativa

En el presente artículo se propone la posibilidad de realizar exploraciones jurídicas desde un enfoque fenomenológico, el cual propondrá a la narración como herramienta específica de tal alternativa metodológica, pero determinando consistentemente su enlace con el quehacer propio del Derecho. Para ello se realizará un recorrido que abarcará el problema del enfoque constitucional respecto a la administración de justicia, la función del juez en la misma de acuerdo con la Constitución de 1991 y las interpretaciones planteadas por la Jurisprudencia sobre la misma. Luego, se propondrá al juez como personaje trágico al considerarlo bajo la paradoja de ser primero el sacerdote de la geometrización del campo de inmanencia del deseo, para convertirse luego en un personaje nietzscheano, lo cual pondrá de relieve la inadecuación irresoluble entre lo legal y lo justo en sus actuaciones. El artículo finaliza señalando cómo se manifiesta ese personaje trágico en la narración, con lo que queda precisada la primera condición de la fenomenología jurídica.
