Las tendencias jurisprudenciales emitidas por la corte suprema de justicia, establecen un derrotero frente a la carga de la prueba en la responsabilidad civil médica a partir de 1940 hasta la actualidad. La responsabilidad debe mirarse como la consecuencia de una relación entre una obligación y un derecho, la obligación se refiere a la persona que presta un servicio o cumple un mandato, mientras que la persona es quien puede hacer valer ese derecho como mandante por la condición personal, sino que se encuentra en determinada situación específica y requiere ejercerlo. El médico como todo profesional, es responsable de sus negligencias y de una mala práctica, por lo tanto las consecuencias legales tanto por acción como por omisión causando daño a otro, está obligado a reparar el daño causado.
