El Medio Ambiente como objeto de protección jurídica en el ámbito comunitario: hacia un sistema de Responsabilidad Ambiental

El origen de la protección ambiental es bastante reciente. Apenas a finales del
siglo XX se dan los primeros pasos en dirección a la tutela jurídica del medio ambiente, a partir de las Conferencias de las Naciones Unidas. A nivel comunitario, en la versión primera del Tratado de Roma que inauguraba la Comunidad Económica Europea, la protección del medio ambiente todavía no se hacía expresa. En la actualidad, son seis los Programas de Acción de la Comunidad Europea sobre el Medio Ambiente. La Directiva 2004/35/CE sobre Responsabilidad Ambiental en relación con la Prevención y Reparación de los Daños Ambientales constituye el desarrollo normativo más importante en este ámbito.
