Como derecho colectivo de la Constitución de 1991, el espacio se manifiesta en la Constitución y diversas leyes con la naturaleza de ser público. En este caso se
toma el espacio como un derecho ambiguo y amplio enmarcado dentro de los
significados y teorías del Derecho, mencionando algunas repercusiones que son
motivo de debate en lo académico, lo investigativo y lo estatal. Se destaca como el Derecho influye en las distintas actuaciones de los actores sociales, jurídicos y judiciales, reorientando sus finalidades e impactando la sociedad en sus problemáticas y dinámicas desde perspectivas muchas veces alejadas de los
intereses de la comunidad. En este sentido, la reevaluación de los conceptos
tradicionales del derecho continental frente a la forma de asimilar y comprender el Derecho, se manifiestan en el Espacio Público como una de las figuras donde el interés público reaparece como sustento dinamizador que se integra al Derecho, impactando con él las necesidades sociales para las cuales es creado y dirigido a los individuos como actores sociales necesarios para la construcción de lo público en el área jurídica.
